Terms of Service

1. Acceptance of Terms

By accessing or using HyperTrain ("Service"), operated by Squidcode LLC ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

HyperTrain provides donation-powered HypeTrain overlays for live streamers. The Service includes a web dashboard, real-time OBS browser source overlays, donation page hosting, and integrations with third-party payment providers (Ko-fi, PayPal, Streamlabs, StreamElements, Fourthwall, Patreon, and others).

3. Accounts

You must authenticate via Twitch OAuth to use the Service. You are responsible for maintaining the security of your account and for all activities that occur under your account. You must be at least 13 years old to use the Service.

4. Payment and Billing

HyperTrain offers a free tier for streamers receiving less than $30/month in donations through the platform. Premium features are available for $10/month. Payment processing is handled by Stripe. All fees are non-refundable except as required by law.

HyperTrain does not process or hold donations between viewers and streamers. Donations flow directly through your connected payment provider (Ko-fi, PayPal, etc.). We are not a party to those transactions.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any applicable laws
  • Violate Twitch's Terms of Service or Community Guidelines while using HyperTrain
  • Attempt to interfere with or disrupt the Service or its infrastructure
  • Use the Service to facilitate fraud, money laundering, or deceptive practices
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Resell, sublicense, or redistribute access to the Service

6. Intellectual Property

The Service, including its design, code, graphics, and content, is owned by Squidcode LLC and protected by copyright and other intellectual property laws. You retain ownership of any content you create or upload through the Service (custom sounds, images, branding).

7. Third-Party Services

HyperTrain integrates with third-party services including Twitch, Ko-fi, PayPal, Streamlabs, StreamElements, Fourthwall, and Patreon. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, Squidcode LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via the Service or by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
